Seems to be two options here.
Either David Brooks - the author of this piece about how the Epstein files are irrelevant - told his NYT editors he was in the Epstein files or he didn’t.

Trump is basically using the FBI to fabricate politically charged cases, even if they don’t hold in court the objective is to flood the media and information space with the idea that they are legitimate and manufacture a crisis to justify his illegal actions.
