the birthright clause was not just written to wipe dred scott off of the books, it was written to repudiate the *idea* behind dred scott, you might say the larger *ideological project* of dred scott. and the whole of section 1 of the 14th amendment is a constitutional statement of political equality

i think to understand the meaning of the birthright citizenship clause to the framers of the 14th amendment, you have to understand significance of dred scott to the civil war republican party. dred scott wasn't just a bad ruling, it was understood as a rejection of the declaration itself.

In a 6-3 decision, the Supreme Court ruled that the constitution is actually just one big paper bag test
The Supreme Court just handed Texas Republicans at least 2 more House seats & possibly up to 5 despite the state GOP explicitly justifying their remap based on an unconstitutional use of race in redistricting.

Unsurprising from this court, and it's a bad sign for the upcoming Voting Rights Act case

They basically fault the panel by saying that they failed to apply the presumption of legislative good faith and failed to take a near-dispositive adverse inference against the plaintiffs for not providing an alternative map.

But the panel expressly considered both of these things.
#BREAKING: Over dissents from the three democratic appointees, #SCOTUS puts Texas's new House maps back into effect for (and, presumably, through) the 2026 midterms.

It was physically impossible for that boat to reach anywhere close to the United States, even before it was a flaming upside-down wreck, and Tom Cotton knows that. He's not that stupid, he just thinks everyone else is. This kind of dishonesty is inseparable from egotistical arrogance.
