Fun Fact: I once worked on a high profile prosecution in EDVA with Pat Fitzgerald and his team of AUSAs, all of whom were from outside the district. Let's just say that these Virginia judges do not take kindly to outside agitators, even those from the Department of Justice.

At one point during the hearing, the judge asked the prosecution why the case can’t be tried before mid-December.

Lemons replied: We are “just getting our hands around” discovery in the case.

There’s lots of it, he added, and it includes a “significant” amount of classified information.

This is *exactly* right. The purpose of the shadow docket would be basically the opposite of this—e.g. to step in if a circuit court were going to allow summary deportations that placed individuals in danger. The conservative justices’ actions here are perverse.

Let’s spell this out. Trump fired a qualified U.S. attorney who refused to do his bidding and installed his own personal lawyer to punish a perceived opponent. Justice needs to follow the law, not politics.

This is an attack on the rule of law. Full stop.

It's very hard to build a leak case based on circumstantial evidence, but it's very easy when you have the defendant meeting all the elements of the crime in a single email.

People like to give Obama and Holder the credit/blame for the rise in leak prosecutions, but the truth is that it's because a bunch of current and former government officials like Bolton became really stupid in their US of email, & also forgot about digital forensics

There's a big question here of how the USG found out about the email hack (likely through espionage).

It's also notable that the USG was willing to declassify that for the purpose of executing the SW. Even though it's redacted, SWs are almost always unclassified, & this one has no markings.

Reading the tea leaves in this heavily redacted affidavit, it looks like: (a) Bolton likely retained some classified docs (likely notes) from his tenure as APNSA & (b) a foreign country hacked his email account & that revealed that he retained and/or was sharing classified info.
