DOJ says immigration judges, as "inferior officers," may be fired on the basis of sex, religion, race, or national origin. Leaving aside the law, it's *politically* remarkable they're taking this position.

As explained further below, however, your status as an inferior officer under Article II of the Constitution renders you an “at-will” employee, and your removal is beyond the purview of Title VII. Regarding your client’s claim that her employment as an Immigration Judge was terminated, this decision was a lawful exercise of the Attorney General’s authority under Article II of the Constitution. Article II of the Constitution allows the President and heads of departments exercising his power to remove inferior officers without cause, subject to only narrow exceptions that do not apply to your former position. No statute provides otherwise, and even if it did, the statute would run afoul of Article II.

And the first woman in a presidential Cabinet. Born in Boston, she studied, she studied physics at Mount Holyoke College. Her professor took students to tour factories along the Connecticut River. Frances saw exhausted girls younger than herself in abysmal conditions, inspiring her to earn a master's degree at Columbia University in economics and sociology, writing her thesis on malnutrition in Hell's Kitchen. By 1910, she was Executive Secretary of the New York Consumers League, investigating factories, documenting violations, pushing for reform: clean bakeries; safe exits; maximum working hours. She testified before legislative committees, telling powerful men their factories were killing people. Then came the Triangle Shirtwaist Factory tragedy on March 25, 1911. She watched young women jump from 9-floor windows because the factory owners had locked the doors to prevent "theft" and "unauthorized breaks." Most of the 146 workers who died were immigrant women and girls, as young as 14. Within weeks, Frances was appointed to the committee investigating the fire. She didn't just write a report. She rewrote New York's labor laws from the ground up: Fire exits—unlocked, accessible, clearly marked; Maximum occupancy limits; Sprinkler systems; Regular safety inspections; 54-hour maximum workweek; One day off per week. New York passed the laws. Within a decade, American workplaces had been transformed. In 1933, Franklin D. Roosevelt asked Frances to join his Cabinet as Secretary of Labor. She was 53 years old. Frances agreed, but only on her terms: A 40-hour workweek; A minimum wage; Abolition of child labor; Unemployment insurance; Old-age pensions. Roosevelt said they were impossible demands. Gloria Richardson (1922–2021) was a bold and influential leader in the American civil rights movement, best known for her work in Cambridge, Maryland, during the early 1960s. As the head of the Cambridge Nonviolent Action Committee (CNAC), she led protests demanding not only desegregation but also jobs, healthcare, and better housing—broadening the civil rights agenda to include economic justice. Born into a prominent Black family and educated at Howard University, Richardson returned to her segregated hometown and quickly became a key figure in the fight for racial equality. Unlike many civil rights leaders of her era, she did not shy away from the idea of self-defense when faced with violence, challenging the mainstream movement’s commitment to nonviolence.
