As Justice Kagan begins her dissent by pointing out, what is even the point of trial, of fact-finding, of clear error, of standards of review, when the Supreme Court simply ignores every single part of that and decides everything purely on the papers without any real consideration of the facts?

If/when Democrats regain control of Congress, the path is clear. No clerks. No building. No shadow docket. Nothing, until you stop ignoring the law, data, history, precedent, & the plain meaning of words in the Constitution. And there will be 25 of you, with 9 chosen by lottery for any one case.
Again, because the 9 Wizards In Robes, of both parties, believe they & SCOTUS are entitled by God to be an all-powerful Super-legislature, adding seats (& slashing the clerks/building budget, & making them ride the circuit, etc.) has now become the only serious “moderate” & “pro-democracy” position.
Justice Sotomayor suggests—implausibly—that justices somehow have a vested property interest in their office. Yet another reason why relying on judges to be reformers is an absolute disaster.

The majority of voters in Davidson County (which includes Nashville), voted for Behn today. However, thanks to gerrymandering, they don't receive fair representation. These underhanded tactics are fundamental to the GOP cult. Blue states can't afford to take the high road in redistricting fights.
