An attorney who fails to raise a procedural issue that would have ended a case for a defendant has not preserved it for appeal, and could also be subject to discipline and/or a malpractice suit. Also… procedure is how rule of law functions predictably. It matter for more than formalistic reasons.

Say what you will about this, the dumbest, cruelest timeline, but you have to admit it’s going to be fun watching law schools fight over the hottest young scholars specializing in (checks notes) interstate compacts and the Third Amendment.
