I was skeptical of this when Ian pitched it but came out convinced that it’s at least worth considering, especially the danger to victims and witnesses who spoke to DOJ about the horrors of their lives, and may now face of retribution from some of the most powerful people in the world.

"There is danger, however, in requiring the Justice Department to reveal the fruits of a criminal investigation — even in a case as compelling and as egregious as Epstein’s," writes @imillhiser.bsky.social.

Here's why 👇
The case against releasing the Epstein files
DOJ has strong norms against releasing information outside of a criminal trial, and for good reasons.

Really good overview from @imillhiser.bsky.social of the paths to accountability for ICE in court—and how the Supreme Court has blocked off some (but not all) of them.

I may be slightly more optimistic than Ian that the Federal Tort Claims Act remains a viable option. www.vox.com/politics/464...
How the Supreme Court placed ICE above the law
Broadly, there are 5 ways to constrain rogue federal law enforcement agents. The Supreme Court nuked 3 of them.

When you cannot trust the justices to apply the law equally, one wonders how they could weaponize one of America's most righteous and effective laws to help their own political party and to hurt their political enemies. Troubling piece from @imillhiser.bsky.social: www.vox.com/politics/464...

Trump’s decision to target former FBI Director James Comey reveals that he will turn on people who’ve benefited him in the past the moment he thinks they have raised a hand against him. And he is willing to use the full power of the US government against people who’ve displeased him.
