Me neither—my assumption is that in the short term, we are going to get terrible law on this. A Supreme Court that would immunize Presidents from liability for criminal acts would do anything without blinking. Learned Hand wasn’t wrong when he said. “For myself it would be most irksome…” 1/2
I count 11 judges who would be likely to vote as the majority did here: Bade, Bennett, Bress, Bumatay, Callahan, Desai, Forrest, Ikuta, Miller, Nelson and Van Dyke. Murguia will be on the panel so you need 6 of 28 to come from that group to uphold this if rehearing is granted—not great odds.
Lower court judges are playing an important role here, letting us know that they can see that what the Administration is doing is unjustified and illegal in length well reasoned decision. It’s painstaking work that is worth doing and I’m glad they are doing it.

The Seventh Circuit’s conflicting decision in a case with facts that were more favorable to the Administration, makes en banc rehearing more likely still.
Given the fact that the panel gave Judge Immergut the back of their hand in a particularly cavalier way and the intensity of Graber’s call for en banc review, I think the likelihood of en banc rehearing is pretty high.
Justice Jackson accused the current court of having two rules: Calvinball (there are no rules) and the GOP Administration always wins. If Democratic Administrations want to actually govern, expanding the court is a necessity.
No—the next step is to petition for rehearing from the full Ninth Circuit which will vote on whether to grant en banc review before an 11 judge panel.
I think Leah Litman’s critique of the Supreme Court is fully justified. I also think that many lower court judges and the three Supreme Court judges who are dissenting from this are doing extraordinary and commendable work. lareviewofbooks.org/article/why-...

The number of Supreme Court judges is not inexorably fixed at nine. Congress might want to bear that in mind in 2029 and thereafter.

It’s worth a try, but I’m not sure it will work. From what I’ve seen of the conservative supermajority in this Supreme Court, they will do whatever they need to in order to continue to give the GOP a leg up.
Maybe wait a day or two to see if it falls apart (which it has). Give Obama credit—he’s smarter than that.

Also—excuse me. Your knowledge of American History has to be thin not to understand the role of racism in pre WWII American and the Southern Strategy that the GOP adopted from Goldwater forward.
That really is a nuts response, as the author of the original post noted. If you weren’t watching the racism at Palin Campaign rallies and Tea Party rallies in 2009, you weren’t paying attention. If you can’t see Trump explicitly ran on race in 2016 and 2024, I can’t help you either.
