“Freedom of speech” is not synonymous with, and not limited to, the First Amendment. Freedom of speech is a value we can all choose to uphold in our workplaces, schools and social circles. It is in tension with other values, such as safety and decency. The government has no choice. We do.

Of course, it’s always conservatives demanding public projects (eg bridges) be done as cheaply as possible so they look plain and unattractive.

There’s a length of sample below which clearance isn’t required IIRC. And it got regulated by a court decision. But my knowledge is basically from an On the Media segment I heard like 10 years ago.

But I think your concept of applying the same rules as sampling is intellectually sound.

This argument doesn’t grapple with the most common complaint made by authors: they didn’t get paid. When I read a book that is in copyright, I paid for it, or the library I borrowed it from paid for it, etc. Anthropic did not.

And “this settlement is bad, we should have UBI instead” is just goofy.

Currently remix culture is legally limited when humans do it. Public Enemy can only sample so many sources per song. Why should that limit exempt these companies?

The only thing getting in the way of us watching anything we want is corporate decision-making. Unfortunately there is a lot of it and it is packed with bullshit. It is all run by the marketing department at the Sirius Cybernetics Corporation.
