More judges speak to the press (the NYT) about what a disaster the Supreme Court (specifically the shadow docket) has been - “incredibly demoralizing & troubling”; a “judicial crisis”; a “slap in the face to district courts.” www.nytimes.com/2025/10/11/u...

In the ninth day of a government shutdown, the conservative-led Senate is proceeding with Trump’s controversial judicial nominations. Later today, Jennifer Mascott is set to be confirmed to the Third Circuit seat in Delaware despite having little connection to the state.

Ok, here we go.

The case is called and Judge Immergut explains the background. She says there were technical difficulties, which caused the delay.

The Supreme Court’s ‘shadow docket’ is moving fast—making major decisions with little explanation. One new case could even reshape presidential power. Here’s why you should be watching.

Beckwith said: "We have to stand up and insist the laws be followed.”

A career public servant being removed from her post is part of an extremely troubling pattern of this Administration going after US Attorneys courageously standing up for the rule of law and honoring the oath they took.

BREAKING NYT:

Trump just fired a U.S. attorney who insisted on following a court order.

Michele Beckwith, the top federal prosecutor in Sacramento, was fired hours after she reminded a Border Patrol chief to abide by court-ordered restrictions on immigration raids.

BREAKING: The Supreme Court greenlights Trump's "pocket rescission" of $4 billion in foreign aid appropriated by Congress.

Kagan, joined by Sotomayor and Jackson, has a sharp dissent. She says this "result conflicts with the separation of powers." www.documentcloud.org/documents/26...
deliberation. So the standard for granting emergency relief
is supposed to be stringent. The Executive has not come
close to meeting it here. And the consequence of today’s
grant is significant. I appreciate that the majority refrains
from offering a definitive view of this dispute and the questions raised in it. But the effect of its ruling is to allow the
Executive to cease obligating $4 billion in funds that Congress appropriated for foreign aid, and that will now never
reach its intended recipients. Because that result conflicts
with the separation of powers, I respectfully dissent

Today's bonus "One First" looks at how #SCOTUS's removal rulings have reconfigured the relationship b/w stare decisis and emergency relief.

"There may be persuasive justifications for such a bizarre reconfiguration of equitable relief. But, once again, the justices aren’t deigning to provide them."
Bonus 179: The Stare Decisis-Free Docket
The Court's recent treatment of Humphrey's Executor may only encourage lower-court judges to do exactly what Justices Gorsuch and Kavanaugh purported to rail against in August: not follow precedents.

This is a crucial point, which Congress ignores at democracy’s peril.

in a sane world, this would be an impeachable offense & articles of impeachment would be drawn up tomorrow.

just as Jimmy Kimmel’s case wasn’t about Jimmy Kimmel - but about state sanctioned censorship - the Jim Comey case isn’t about Jim Comey. It’s about the rule of law versus authoritarianism.

With new reporting that the DOJ is possibly targeting OSF for criminal prosecution, it bears repeating that any politically motivated investigation or prosecution risks the stability of our criminal legal system and ultimately our democracy.

Congress and courts must stop this lawlessness.
acslaw.bsky.social
If Congress continues to abdicate its constitutional duty to consider impeachment, it's even more important for courts and lawyers to serve as a bulwark against further lawlessness. (4/4)
acslaw.bsky.social
Trump's demand that DOJ seek reprisal through prosecution against political opponents, including for his prior impeachments, are themselves impeachable offenses for which legislators have a duty to hold him accountable. (3/4)
acslaw.bsky.social
For our system to survive the damage caused by these egregious departures from the rule of law, courts and individual lawyers will need to reject these politically motivated prosecutions and act according to the law and ethical obligations of the profession. (2/4)
acslaw.bsky.social
🧵 This is a death knell for DOJ prosecutorial independence central to a stable and nominally fair criminal legal system. Trump publicly calling on DOJ to pursue politically motivated prosecutions and firing prosecutors for a refusal to indict w/out evidence fatally delegitimizes that system. 1/4
Former FBI Director Comey expected to be indicted soon in Virginia federal court: MSNBC
James Comey reportedly is being investigated for possibly lying to Congress during testimony in 2020 about whether he authorized a leak of information.
