This is interesting. Has anyone seen scholarship (defined loosely; I'll accept speculative musings and unhinged rants) on the impact of this on Art II courts (and military courts specifically given the various constitutional due process rules at play)? I haven't seen anything.

But then the problem is going to be I didn't get triple overpaid and I'm not going to be happy at missing a windfall. Which is the real tragedy here.
It's not going to be up the admin. It's going to be a thing DFAS does on their own volition. The admin would have to affirmatively intervene to tell them to let it go which I don't think they'd do although honestly, predicting anything anymore with any certainty is beyond me.
Because eventually they figure out they mispayed you and claw it back, and if you foolishly spent it as if it was your money you wind up hurting.
"Wow, half of us got triple paychecks. Let's go and spend it now! Nothing bad will come of this."

I'd think the other reason they'd hold back is the Dems wouldn't feel beholden either (maybe revise the OLC opinion that started this) and this is a significant leverage point they like to have in their arsenal too?
