The Civil Rights Act of 1866 literally says that all persons “can “make and enforce contracts, to sue, be parties, give evidence, and to the full and equal benefit of all laws and proceedings for the security of persons and property as is enjoyed by white citizens.”

It's wild that following Brown v Board of Education, Courts repeatedly used race-based remedies for de jure and de facto segregation. But the position of SCOTUS now is that remedying racial discrimination using these same tools is unavailable to Congress and the President.

It has struck me for a long time as another example of judicial aggrandizement. Under these rules, only Courts can remedy racial injustice.

Breaks my heart. I don't know how these people directing this and executing this sleep at night.
In Virginia, when his daughter learned to count to 10 before she turned 2, he prayed she would grow up to work for NASA as a scientist.

He wonders what his three-month detainment has done to his kids, both U.S. citizens. They sometimes refuse to eat now, and his daughter no longer sleeps through the night. When they ask where Dada is, E doesn't know what to tell them.

The first time they visited him at the detention center, his son, a toddler, climbed atop the table and pounded his small fists into the glass that separated them. "Open it!" he screamed. "Open it!"

Afterward, H asked his wife not to bring them back for a while.

Now, his mind returns every day to what an investigator told him just after the arrest.

"What will happen to my wife and kids?" H asked.

"Don't worry," he said the agent replied. If the U.S. government sent him back to Afghanistan, it would send them, too.

If they're not ready to give a fulsome opinion on what the law is, they can simply leave lower court orders in place like they do for almost every legal dispute that takes place in this country.

The other thing is that Barrett and others are not acknowledging that they don't have to be giving this relief at all. Emergency relief like this is supposed to be an extraordinary remedy yet they're doling it out in high profile cases with no consideration of factual findings in lower courts.
