As far as the UCMJ, an unjust order is specifically defined as a unlawful order. Just can't split hairs between the two. The JAG lawyers at the pentagon have the burden placed on them to determine what order is lawful or unlawful. The courts decide on NG issues unless the NG has been federalized.

If a military member refuses to follow an order, they are subject to court martial and imprisonment. If they knowingly follow an unlawful order, they are subject to court martial and imprisonment. Very stressful, especially when you have a president who doesn't care if his orders are lawful or not

How can you say they are "unjust" if it was challenged in court and the judge decided the orders were not unlawful? This is the problem today with so many serving our country. They are to assume orders are lawful but need further education as to what definitely constitutes unlawful orders.

The president can order them, but they are not part of the military until they are federalized. The national guard sent by the WV governor were sent voluntarily by the governor at the "request" of Trump. Only under extreme circumstances can the president override the governor regarding the NG.

They were never federalized. The president has the authority once they are federalized. They pretty much give the same oath as military members give regarding the Constitution. But they are mostly under the orders of the state's governor under most circumstances. The court decided the legality.

Don't confuse the National Guard with our branches of the military. They are not under the same statutes as our National Guard, which are under the Governor's authority.

West Virginia law allows for the National Guard to be sent out of state for military duty. The deployment was authorized and has been legally upheld, with a judge dismissing a lawsuit that challenged the governor's authority. The judge's ruling affirmed that the Governor's order was "lawful." sad

Trump wants the US to be the global leader in AI. But at what cost? Will it be worth it? Seems like he is getting the cart before the horse. Just like any structure needs a good foundation, AI needs a good foundation, starting with the power and cooling demands FIRST.
