wasn't this settled law on SCOTUS precedent for a century, though? that the same rights are inherent in all humans, and that the US is meant to respect those rights in lands governed by the US constitution?

thank you, that's very interesting. i was surprised at how recently this and Miranda became precedent, and indeed how new our rights to defend ourselves from the crushing arrest and prosecution powers of the State are -- in my lifetime!

this year i learned that the universal availability of counsel under the 6th due to Gideon v Wainwright, 372 U.S. 335, in 1963. this was a SCOTUS decision based on the 14th and extended right to counsel in non-capital cases in some states like Florida.

these days, precedent is weak, though.
