My main thought is this: If the trump administration's victims were half as dangerous as trump falsely claims they are, a helicopter approaching that low and slow would have been blown clean out of the sky by a MANPAD.

It's kind of funny, even.
They fuck up cases like this ALL THE TIME, this isn't an anomaly. Just normally they're doing it to people who have a public defender who does not have the time or resources to dismantle the BS.
But in this case, Luigi has some of the best lawyers NYC has to offer.

Honestly, it sounds like they fucked up searching his backpack badly enough that they might have to throw out everything in it (in terms of evidence) anyways, which would completely nullify the contents of the notebook and if it is actually his or not.

If he's even the guy, they probably found him through some fucked up Patriot Act BS that would not pass muster in front of a jury or if it was challenged on constitutional grounds, so did a little bit of parallel construction to write the "manifesto" and needed to plant it. And fucked this up badly.
