Correct. I've never claimed this is a recent invention. Only that the foundation of the fiction lies in state constitutions.

The federal government doesn't charter corporations--states do! And there's no constitutional authority for SCOTUS to create corps. SCOTUS is expanding what states created.

I was in law school a little after you, got my JD in 2002, then pursued my LLM in tax. Have been in govt law since 2002.

State constitutions & legislation create personhood status for corps. Federal govt cannot confer such status without that underpinning bc corps are sitused in states.

Ummm... no.

States created the foundation of corporate personhood. SCOTUS took full advantage of that by expanding the meaning of free speech.

But much of free speech law is judicial. Look at what the Constitution says about free speech... very limited & only prohibits government infringement.

Neither. SCOTUS determined that money given to political campaigns was a form of free speech for persons. Bc states created corporate personhood, corps have freedom of speech in the form of political donations.
