I think the only thing they're legally required to broadcast is political advertising for Federal elected positions. Anything else, they're given discretion as to whether or not to air the message (that is, to form a business relationship with a particular client.)

The claim was that her not finishing first in one event "proved" that there was no inherent advantage to her having been exposed to gonadal testosterone during adolescence, but if you look at literally the entire rest of her record she is, as it were, head and shoulders above the rest of the team.

(It's typical in electronics development to call for max-spec parts in the first builds, and then after field experience you can back off the parts that don't need it; this can lead to dramatic cost decreases with no change in physical design or process.)
