Since her passing, grandchildren, nieces, and nephews have been born — children who never got the chance to know her, yet whose lives have been deeply affected by her loss. It has now been 18 Christmases, 18 birthdays, 18 Thanksgivings that we have missed with Jackie, while the people responsible have continued to celebrate those same milestones with their families. The lawyers argued Residential “school” survivors were a homogenous group, equating Residential “school” survivors with those in chosen professions such as taxi drivers, lawyers and cashiers. Claiming survivors could not be harmed as a group by words of denial and without a specific person targeted the defamation action should not proceed. Fortunately, this shameful argument was not accepted by the court.
