As to the second point-ADA interpretation is state by state, and I don't know Oregon, but I am confident that the patio you show here wouldn't be considered ADA-compliant in any US state, and the design requirements I'm seeing from the city guide are pretty clearly geared towards accessibility.

Weird bit of trivia I came across this morning—apparently after Boston’s Little Jack Horner Joke Shop went out of business in the 90s its inventory and sign were purchased by a propane and welding supply company who still sell fake dog poop etc. alongside their more conventional products.

so putting it all together: on the left we have a pin oak with an open branch angle and strong apical dominance. On the right is a zelkova with a tight branch angle and weak apical dominance. See the difference?
