This is all to say I don't disagree with the sentiment of hard punishment for this shit. It's more a product of maximizing what an understaffed state AGO (they are all understaffed) can get done.

Trials are not guaranteed wins, especially old conduct (blame FERC for 6 years of delay) and the remedy may be better at trial but it can also be worse. Balancing that risk plus the litigation costs in time and attention, makes settlements like this hard calls.

Third, and probably most significantly, the conduct is old. Getting to trial, remedies, and appeals, could put a remedy even further years out. I'm guessing there was a real conversation about balancing getting real money in people's hands today vs tying up resources for a possible win tomorrow.

There's a few things that may be at play. First, we don't know the full scope of the harm from the article. The settlement may include interest as part of the calculation. Second, prejudgment interest is a remedy that would happen if the case got to trial, but IL's interest rate is pretty weak.

Not an professor, but as someone with both a CS and a law degree, I would have loved at least some part of an oral exam. It's both a useful skill set for the career and fast way to (in my mind) evaluate understanding of a subject. It does seem hard to wrangle a bigger class though.

I'd not been with you on Blansas, but Marshall won by about 12 in a year dems were +4.5 nationally. If dems are +13-14 nationally...idk, that race gets a lot more interesting.

Statewides too. AG and Governor I think could be very close.
