What I honestly think separates Jewish legal tradition from the modern traditions of American Originalist Tabula Rossa and Hasidic Reactionary Theocracy is that Rabbinic Judaism asks you to imagine that judges weren't literally born yesterday, and admit that the law is interpreted by human beings.
