Either Section 4 of the 25th Amendment must be invoked — because he is “unable to discharge the powers and duties of his office” — or he must be impeached and convicted under Section 4 of Article II of the Constitution for “treason, bribery, or other high crimes and misdemeanors.” Here are a few specifics instances that justify the move, and recent actions against Venezuela could likely also be added to the list. 1. January 6 actions — accused of undermining democratic processes (often labeled “treasonous” by commentators). 2. Ukraine affair — impeached for abuse of power tied to foreign influence. 3. Using government institutions to target political foes. 4. Unconstitutional pardon announcements. 5.
