The divide between Justice Kagan and Justices Sotomayor and Jackson over #SCOTUS’s “clarification” in the third-country removal case reflects a broader debate over the role law (and legal arguments) should play in response to mounting executive branch lawlessness.

More in a July 4 “One First” post:
164. Justice Kagan's D.V.D. Concurrence
Thursday's denouement in the third-country removals case was not surprising. But the split between Justice Kagan and Justices Sotomayor and Jackson highlights a deeper (and July 4-appropriate) debate.

Total spending on prisons across all fifty states? That system that holds 1.4 million ppl per year? The (until recently) largest incarceration rate in the world?

$60 billion.

ICE alone will get 2/3 of that.
If the GOP reconciliation bill passes, ICE gets through FY2029:

- $45 billion for detention, on top of the current annual budget of $3.4 billion
- $14.4 billion for transportation and removal, on top of the current annual budget of $750 million
- $8 billion for hiring/retention
- Billions more.

This is bad. Republicans have fixed the contempt provision in the billionaire bailout bill so bond has to cover the costs. It can’t be $1 anymore. This will neutralize the court’s ability to hold Trump in contempt, and only rich people will be able to file injunctions against the government.
As I just flagged, this has been replaced with something which is arguably worse; requiring that basically every plaintiff seeking a preliminary injunction against the federal government pay millions or billions of dollars in "security" to pay for "costs" to the federal government if they later win.

Oklahoma receives about $3 billion more in federal spending than it pays in federal taxes. That's nearly $8,000 per Oklahoman--only 9 states have a higher per capita balance of payments. Subsidies from MA, NJ, WA, CA, and a few others are how OK remains a "low tax state."
Sen. Lankford: "The Senate is not really excited about the SALT deduction piece ... we want to be able to say if you live in a high tax state, the option for you is to move out of a high tax state."
