You can land in contempt of court for violating a court order. There's an argument for treating the violation of the Epstein Transparency Act as the violation of an order. It's not a statute with general application. Only the DOJ can violate it.

Defying a subpoena is one thing that can land you in contempt of court, but it's not the only thing. There's reason to think that might have a parallel in Congress.

In what I think is the earliest case on the subject, Anderson v. Dunn, there doesn't appear to have been any subpoena at all.

So... it's not entirely clear to me that inherent contempt requires that there be a subpoena issued and then flouted.

In practical terms, that is what Members will likely insist on as grounds for their vote. But I'm not convinced it's actually necessary. Maybe a good idea, but not a requirement.

I was just writing some notes about this for myself. There are two basic approaches:

1) Break the power of the court, or 2) capture its power from the radical right.

Capture is technically easiest: just expand with a Dem president to appoint 5-7 new justices. Straightforward, but yes, arms race.

Breaking its power means changing how it operates.

"Circuit-izing" the court by expanding it & having it hear cases on randomly selected panels weakens it by dividing it internally. Adding members randomly from the circuits also; so does reforming the cert power to abolish the shadow docket.

Third: The text of the Constitution promises that appointment to the federal judiciary is for “good behavior,” which is a term with a commonly accepted meaning at the time that can be redefined. Moreover, it says being a federal judge is a good behavior gig—not the circuit or role.
