Like Judge Ellis, judges MUST be clearsighted and courageous enough to call this behavior out. We can't hide behind civility and "the way it's always been done" anymore.

That is no longer true as the Administration and its lawyers lie brazenly and often. We see others (private lawyers, attorneys representing states, etc.) employing these tactics as well (it's happened to me repeatedly).

On this point, I'll note that as an active litigator, we are facing asymmetrical tactics in the courtroom these days. The entire legal system is premised on the idea that truth matters and that, in particular, attorneys will be candid with each other and the Court.

Yep, exactly what happened in our case challenging the “bona fide” primary voter law which contains criminal penalties for voting in the “wrong” primary (without defining “bona fide” in the law) despite multiple DAs threatening to prosecute, in one case directly to one of our plaintiffs *in person*
