Associate Professor of Law at West Virginia University College of Law. Formerly an ACLUFL Attorney. I nerd out over free expression, academic freedom, and American history.

All opinions are my own, not my employer's, and are correct, probably.
That style of shoe doesn't fit the casual look. But I certainly have a couple pairs of shoes that are a mix of formal & casual (like this photo). Why? Comfort. I usually dress business casual for work, & they fit the look better than tennis shoes. Formal dress shoes are uncomfortable, so I hate them

I'm referring to the paragraph at the end of the section. The indictment refers to the secondary residence that she allegedly used as an investment property. (At least the part I read did.)

This is one of the sources of error in Cruikshank, which supports my reading of Slaughter-House. The Court in both cases rejected the idea that 14A protected the freedoms listed in the Bill of Rights from state abridgment when they did not implicate national citizenship (i.e., petitioning Congress).

That's a defensible position. My point is more that is how many people in that time spoke of citizenship rights, so I don't think it's as black and white. This is from Curtis's dissent in Dred Scott:

I am excited to announce that my article, Academic Freedom's Inflection Point, will be published in the Boston College Law Review in 2026. The SSRN link is below. I plan to make revisions to address feedback & new developments (ex. a terrible govt speech opinion). Comments are welcome & appreciated!

Wow. This opinion is bad on so many levels. It either misunderstands or misrepresents how grants work. It is disrespectful towards the attorneys representing the plaintiffs (imagine if a liberal made a sarcastic remark about ADF & "freedom"). And it's wrong on standing.

That isn't to say that the power is limitless or SCOTUS lacks the power to say that Congress exceeded its authority. But the question there is whether Congress's enforcement is appropriate. And to be clear, yes, I believe City of Boerne was wrongly decided. Michael McConnel's thesis here is right.

Today, two Trump appointees on the 11th Circuit (Brasher & Luck) absolutely butchered First Amendment doctrine so they could burden LGBTQ+ expression. They flipped forum analysis on its head, analyzing a private party's use of expression (drag performance) rather than the forum itself (public park).

Reminds me of this incredible Nextdoor post. That guy is going to be big mad when all these new honey bees start taking his pollen.

The President also has the inherent authority to quarter troops in the homes of American citizens who criticize him. The President can authorize the soldiers to confiscate the homeowners' weapons and indefinitely detain them until they apologize.

I am not much of a photographer, but this fella (or lady?) loves perching above my home office and shouting at the top of its lungs.
