If SCOTUS were to rule that Trump had no authority to impose tariffs, the likely basis would be that the Constitution provides that using tariffs to raise revenue is up to Congress. His self-defeating response: if the Court overturns the tariffs, that would reduce revenue. He's no legal eagle.

Without congressional approval, Trump could arguably impose tariffs based on national security, unfair trade practices, or to address severe balance-of-payment deficits. But by his own admission, he's doing it to raise revenue, which exceeds his authority under the Constitution.
