The question is, do you feel lucky, human? Well do ya?
To quote Liz Truss (who appointed Falkner), “that is a DISGRACE!”

No, really.

It’s beyond disgusting that the EHRC behaved in this way.
51/ The EHRC Chief Executive, John Kirkpatrick, gave written evidence that it took less than a day to draft the guidance, and just over 24 hours in total to decide to publish it.

50/ On the procedural aspect of Ground 2, Stilitz says it is inappropriate to rush, especially when there is no obligation to provide advice. Doing nothing is better than publishing guidance that is incomprehensible or harmful.
November 12, 2025 at 8:14 PM
Because the bigots in charge of the EHRC don’t see trans people as fully human…
48/ He says, this is in contrast to the old Code, nowhere in the guidance is there any mention of the dignity of trans people or sensitivity in handling these situations. The approach is blunt, matter-of-fact, and fails to account for the specific considerations at stake.
November 12, 2025 at 8:02 PM
The assymetry in risk of discrimination in the guidance is marked.

It’s almost as though the EHRC just decided to abandon trans people entirely 🤔
46/ The guidance mentions the risk of indirect sex discrimination against cis women.

Stilitz points out that there is also a risk of both direct and indirect discrimination affecting gender recognition, yet the guidance makes no reference to these risks, making it one-sided.

I forget exactly when it was (@philippaeast.bsky.social?) but the EHRC at one point was pushing for a “biological” definition of sex, and they also had multiple meetings with the trans-eliminationists at Sex Matters.

They’d been waiting for the SC ruling.

They jumped the gun. And the shark?

a riff on the most famous johnny cash lyric in the replies to an article _about johnny cash_ being interpreted as a death threat is the type of braindead, uncultured and ignorant moderation we've come to expect from the mods here

This has baffled me since April.

“Proportionate” and “legitimate” were tossed out of the window the moment Falkner went on Radio 4 to announce that, henceforth, all trans people were banned from the loos that align with their gender.
35/ Any measures must be a proportionate means to a legitimate aim, designed to overcome or minimise social exclusion.

This consideration is not accounted for in the Commission’s guidance.

My tea this evening has consisted of alcohol and chips (American friends… not that kind, the British kind). I’m about to dive into a Ben & Jerry’s.

Look, it’s been a shit day and the shitty calorific intake has made me feel a little better about myself, mmmkay?

“Regrettable” is a beautiful, almost poetic understatement.
21/ “It is regrettable that the EHRC, rather than carefully considering the judgment and proceeding cautiously, issued guidance that undermines the rights of trans people. That‘s why we are here.”

He now turns to the detailed grounds of challenge.

19/ He says the press summary, as read in the Supreme Court, too shows that the judgment does not move the dial by giving victory to “women’s rights” or defeating trans rights.

It is the EHRC guidance, not the court, that gives preeminence to “women’s rights” and reduction of trans rights.

Thread, for anyone wanting to know what happened on day one of @goodlawproject.bsky.social’s judicial review hearing.

Thanks to @reactiveashley.bsky.social for her reporting 🙏🏻
1/🧵 Today at 10:30am, High Court in London, Court 1, before Mr Justice Swift, R (Good Law Project, on the application of) v Equality and Human Rights Commission, a rolled-up hearing for judicial review of EHRC’s “interim update” (Day 1 of 2)

No live reporting, sorry.

18/ Counsel therefore submits that the old Code does not express a view on the question addressed in Scottish Ministers, so the Supreme Court judgment has no bearing on the continued correctness of the old Code.

He also referred to Lord Hodge’s interview with the press.

Ordered some things online

Website had QR code for tracking

Which asked me to download an app

Which required me to sign up

And link my Google account

To tell me that my order had been delivered

Or was on its way

Or was being prepared

It wasn’t sure

Neither am I

(Except that it’s not here)

~100 letters a day. Thank you!

If you haven’t done it already, could you spare 5 minutes to write to your MP? 👇🏻🙏🏻
I've a favour to ask of my cisgender UK followers. It'll take you 5 minutes!

Please use this template to write to your MP.

I know, I know... AGAIN. But this is to counter the letter-writing campaign undertaken by Sex Matters, who want the awful EHRC trans-exclusionary Code to be rushed through.

Beyond time that Sex Matters lost its charitable status.
Sex Matters coming swinging in to the BBC debate in the only way they can with the demand that trans people be expunged from all media content (unless they're being demonised).

Because that's their aim across society as well as media. Hate groups will push hate, they're just very open about it.

I started to type a reply to this, based on my own experience.

It quickly became too dark, so I deleted it.

Make of that what you will.
I have a closeted, pre-transition transfemme friend in the UK who abandoned her dreams of coming out and transitioning specifically because of how the environment in the UK is. We all embraced her coming out online. But she knew society wouldn't in person. It's crushing. I just want her to be happy.

The way I look at is, I’m a woman because I’m a woman. It’s not ideology, it’s me. A trans woman is a woman in exactly the same way. A trans man is a man because that’s who they are. None of us makes a conscious decision. It’s just we are what we are.

The UK tech minister has said a VPN ban is on the table.
