Temple Hospital Med Mal Case Settles for 'Modest Fraction' of Initial $45 Million Verdict “It is a good day for the courts in Philadelphia,” said John Ryan, Temple Hospital's general counsel. “And for Philadelphia hospitals and doctors.” A medical malpractice lawsuit that once saw a $45 million verdict against Temple University Hospital has now settled with a price far less than the jury’s initial August 2024 award. The specific price point of the settlement remains confidential, Temple University Hospital general counsel John Ryan said, but signifies what he hopes will be a turning point for verdicts against hospitals in the region. “What this settlement does is represent a pretty serious inflection point for the way these verdicts are going in Philadelphia,” Ryan said. “Some of the other health systems have sustained verdicts of over $100 million. Those just aren’t sustainable.” Ryan points to high-priced verdicts Philadelphia and Pennsylvania juries have awarded plaintiffs suing hospitals within recent years—most recently, a $207.6 million birth injury judgment against Penn Hospital in July. The verdict was Pennsylvania's largest-ever reported medical malpractice verdict.

At a hearing on Wednesday at the American Arbitration Association - a neutral third party which resolves disputes out of court - Ms Wynn-Williams was told she must refrain from engaging in or "amplifying any further disparaging, crucial or otherwise detrimental comments. All previous disparaging comments "to the extent within her control" must also be retracted, the ruling also said. The book is former New Zealand diplomat Ms Wynn-Williams' account of joining Facebook in 2011 and watching it grow from a "front row seat". Her allegations include that executives had worked "hand in glove" with the Chinese government on potential ways of allowing Beijing to censor and control content in exchange for access to the lucrative market.

Today’s right wing nonsense: The “Article 3 project” (🙄) filed a complaint against Judge Case for wanting women represented in leadership in an MDL. THEY AREN’T EVEN TRYING TO BE INVOLVED IN THE CASE! This is the equivalent of those dudes that sued bars for Ladies’ Night. Pathetic behavior.
Dear Chief Judge Pryor, I write to submit a complaint of judicial misconduct against the Honorable M. Casey Rodgers of the United States District Court for the Northern District of Florida. This complaint is submitted pursuant to the Rules for Judicial-Conduct and Judicial-Disability Proceedings and concerns improper statements made by Judge Rodgers during the First Case Management Conference in In re: Depo-Provera (Depot Medroxyprogesterone Acetate) Products Liability Litigation, MDL No. 3140, on February 21, 2025. I. Background During the First Case Management Conference in MDL No. 3140, Judge Rodgers made statements that improperly suggested that sex would be a relevant factor in selecting leadership counsel for the multidistrict litigation. Referring presumably to the fact that the case involves a birth control product and “particularly, in this litigation, because of the Plaintiffs,” Judge Rodgers stated “females need to be adequately represented in your leadership.” Tr. 61, lines 12- 16. This was coupled with a more general and troubling statement about “diversity” that appears on the same page of the transcript. Id. at lines 9-13. This remark reflects an explicit preference for females in the allocation of professional roles and responsibilities. By implying that sex—rather than qualifications, experience, or merit—should influence selection for MDL leadership, Judge Rodgers engaged in conduct that constitutes impermissible bias and judicial misconduct. II. Judge Rodgers’ Conduct is Cognizable Misconduct A. Discrimination on the basis of sex in selecting leadership counsel is judicial misconduct Under Rule 4(a)(3) of the Rules for Judicial-Conduct and Judicial-Disability Proceedings, judicial misconduct includes: “Intentional discrimination on the basis of race, color, sex, gender, gender identity, pregnancy, sexual orientation, religion, national origin, age, or disability.” By suggesting that female attorneys should be prioritized for leadership roles based on the nature of the case, Judge Rodgers openly endorsed sex-based decision-making, which constitutes improper judicial favoritism and violates the principle of impartiality. It should go without saying that Judge Rogers’ statement that “that doesn’t mean I’m looking for every single leadership to be a female,” does not somehow justify the express preference for women. Tr. 61, lines 14-15. Moreover, Canon 2(A) of the Code of Conduct for United States Judges requires that a judge “act at all times in a manner that promotes public confidence in the integrity and impartiality of the judiciary.” Judicial impartiality is compromised when a judge indicates that immutable characteristics such as sex play a role in judicial appointments and case management decisions. B. Discrimination on the basis of sex in selecting leadership counsel also violates the Constitution The Fifth Amendment’s Due Process Clause contains an equal protection guarantee that prohibits government officials, including federal judges, from engaging in sex-based discrimination absent an “exceedingly persuasive justification.” See United States v. Virginia, 518 U.S. 515, 531 (1996). The Supreme Court has repeatedly held that sex-based classifications are presumptively unconstitutional unless they serve an important governmental objective and are substantially related to achieving that objective. Judge Rodgers’ statement suggesting that female attorneys should be favored for MDL leadership fails this standard. There is no legally permissible justification for using sex as a factor in judicial case management decisions. Leadership roles in MDLs should be awarded based solely on merit, experience, and ability—not on sex. III. Need For Immediate Corrective Action Judicial integrity requires that every lawyer appearing before the federal judiciary be treated equally, without regard to sex or any other immutable characteristic…
