Yeah, this has really struck me the last 2 weeks.

Just 1 guy in 1 court, & seen 13 respondents (+1 minor not in proceedings) targeted orally under HO ACA at MCHs over only 8 days (w/IJ side comments suggesting many more in written motions).

Only 1 case/3 (pro se ☹️) resp got OORs the day of, but...
Preliminary data indicates that many more cases have been pretermitted pursuant to the Honduras ACA than can be transferred to Honduras under the current agreement (in which Honduras committed to receive ten third country nationals per month).

One angle I don't think has been entirely reported out is the contribution of changes to, and a presumably related disruption of, ODLS right in the middle of the Herald's survey of former Everglades detainees.

The Herald ran their checks "as of the end of August", and on 8/26 ICE fucked with ODLS.
As of the end of August, the whereabouts of two-thirds of more than 1,800 men detained at Alligator Alcatraz during the month of July could not be determined by the Miami Herald. The Herald had obtained the names from two detainee rosters. Around 800 detainees showed no record on ICE’s online database. More than 450 listed no location and only instructed the user to “Call ICE for details” — a vague notation that attorneys said could mean that a detainee is still being processed, in the middle of a transfer between two sites or about to be deported.

Regarding location information for detainees held at Alligator Alcatraz, on or about September 19, 2025, DHS began implementing procedures to update detainee location information relating to aliens detained at Alligator Alcatraz to the Online Detainee Locator System (ODLS). (Parra Decl., Ex. A ¶ 5.) ODLS is a public, webbased system that allows family members, legal representatives, and members of the public to locate individuals who are detained by ICE. Id. ¶ 6. In ICE-owned facilities, detainee location information is updated in the ENFORCE Alien Detention Module (EADM) database as soon as a detainee is booked into the facility. Id. ¶ 9. Once in EADM, data is automatically uploaded to the ODLS system. Id. Although there are exceptions for certain individuals who do not appear in ODLS, ICE typically updates ODLS within eight hours of release, removal, or transfer. Id. ¶¶ 7, 10. In facilities such as Alligator Alcatraz, detainees are booked into the facility by contractors employed by the State of Florida’s Division of Emergency Management. Id. ¶ 11. ICE typically receives those facilities’ data entries daily around 8:00 a.m.; ICE officers then manually input the information into EADM, which automatically updates information in ODLS relating to transfers, release, and removal. Id. Because of the additional layer of information gathering and data entry, detainee location information relating to release, removal, or transfer at Alligator Alcatraz is uploaded to ODLS within 24 hours acknowledging delay in some instances. Two and a half months after ICE and Florida decided to make their camp in the Everglades a functional blacksite, after multiple lawsuits and innumerable suffering families and frustrated representatives, it looks like they decided to turn the ODLS switch back on overnight.

In this respect, the EOIR Dismissal Policy is in conflict with the regulation that permits a dismissal when the “[c]ircumstances of the case have changed . . . to such an extent that continuation is no longer in the best interest of the government.” 8 C.F.R. § 239.2(a)(7) (emphasis added). Neither the increase in the detained caseload nor the implementation of the ICE Courthouse Arrests Policies represent a change in the circumstances of a case. A change of circumstances of a case is a new fact or condition that is specific to the case at hand, e.g., vacatur of a conviction, a pardon, a change in marital status, or a change in country conditions if a defensive asylum is sought. (See Burr Decl. ¶ 20 (ECF 23-2).) This contradiction alone renders the EOIR Policy on Dismissals contrary to law. 5 U.S.C. § 706(2)(A) (the court shall set aside agency action found to be “arbitrary, capricious, an abuse of discretion or otherwise not in accordance with law”).

Transfers out of the camp have been much faster and more numerous than transfers in since mid-August, usually to detention and deportation hubs in Texas before returning to Alexandria, LA.
Of eight Coast Guard C-27s that have operated since mid-June, all but one appears to have been dedicated to ICE flights. How does one describe a litigation strategy whose facts in support change with each filing?

"Protean" is the word stuck in my mind, for whatever reason.
Next, Defendants’ use of the site includes actions currently taking place in the S.D. Fla. Most importantly, ICE’s Miami field office is responsible for coordinating and supervising immigration enforcement functions conducted by deputized state law enforcement agency officials. (DE 21-1 ¶ 5, 8 (declaration from ICE Interim Assistant Director of Field Operations Thomas Giles confirming that the detention camp operates under Florida agencies’ 287(g) agreements with ICE); DE 118-1 ¶ 9 (declaration from ICE Miami field office director stating that he oversees the relevant 287(g) agreements)). In a different case raising constitutional challenges to detainee treatment on the TNT site, the Federal Defendants filed a declaration by another ICE Miami field office official, Juan Lopez Vega, in which he attested that his responsibilities “include overseeing [Enforcement and Removal Operations], and detention facility operations within the Miami [Area of Responsibility], including those at the South Florida Soft Sided Facility South (SFSSFS). . . . which is also known as Alligator Alcatraz.” C.M. v. Noem, 25-cv-23182 (S.D. Fla.), ECF 50-1 ¶¶ 3–4.18 Given that the sole use of the site is to detain those in federal immigration custody, all activities on the site are supervised and directed by the Miami ICE field office. See supra Section I.B. (quoting language from 287(g) agreements stating, “[i]mmigration enforcement activities conducted by participating LEA personnel will be supervised and directed by ICE.”). Additionally, the Federal Defendants bring detainees from other Miami-Dade detention facilities to the TNT site. (DE 114 at 312–14). In fact, in another case involving the detention camp, Federal Defendants recently filed a notice that “the Executive Office for Immigration Review (EOIR) has designated Krome North Service Processing Center (Krome) as the immigration court with administrative responsibility over the Alligator Alcatraz detention facility.” C.M. v. Noem, 25-cv-23182 (S.D. Fla.), ECF 83. These core actions are alone sufficient to make venue proper in the S.D. Fla. For their part, the Federal Defendants attached declarations from Thomas Giles, Acting Deputy Executive Associate Director for ICE’s Enforcement and Removal Operations (“ERO”), (DE 21-1), and David Richardson, acting Administrator of the Federal Emergency Management Agency (“FEMA”). (DE 21-2).6 Giles stated that ICE’s role in the development of the detention camp has been “limited to touring the camp to ensure compliance with ICE detention standards, and meeting with officials from the State of Florida to discuss operational matters.” (DE 21-1 ¶ 5). He further declared Florida would have final decision-making authority over who to detain at the camp, but that any detentions at the camp would be pursuant to “section 287(g) of the Immigration and Nationality Act [(“INA”)], codified at 8 U.S.C § 1357(g).” (Id. ¶¶ 6–7). Even so, Richardson admitted that the facility would be funded by the federal government, stating that “DHS/FEMA announced $600 million in federal funding for the Detention Support Grant Program [(“DSGP”)]” and that “[t]he only eligible applicant under the DSGP is [FDEM].” (DE 21-2 ¶ 3).

But AFAICT still seems to be primary destination for direct ICE arrests down here last ~2 weeks (not sure about 287(g) LEAs, which are probably the much bigger share overall), AND people seem to be getting transferred out more quickly than the first 2 months, so #'s may be fluid for a while?
