We are obligated to refuse an illegal order. It’s not optional. Following an unlawful order is a criminal act, exposing the ADSM to criminal prosecution. Any ADSM who believes he/she has received an unlawful order must consult with line JAG, and inform your CO of the concern.

Articles 90 & 92 of the UCMJ are clear & explicit in the requirement of ADSMs to follow *lawful* orders from superior commissioned officers. Case law has repeatedly held that, IAW the UCMJ, members are obligated to refuse any *unlawful* order. We cannot allow our armed forces to become rogue agents.

That’s the intent. That’s why Hegseth relieved the service JAGs. A new, broader interpretation of the UCMJ, rules of engagement and the laws of armed conflict. The DoD will now view the posse comitatus act as *permissive* rather than restrictive.

And relieving the service JAGs was a necessary preliminary step.

Through 26 years on AD, I never felt compelled to question orders, nor were any that I issued ever challenged. That thought is front of mind of many I’ve spoken with over the past several months. Bad sh*t is coming to the U.S.

And this is why the service JAGs were among the first to have been relieved. A key step in assessing lawfulness of orders is seeking JAG opinion. Those Corps are now led by sycophants who will have broad interpretations of UCMJ and rules of engagement. Really bad sh*t will happen.
