These platforms maintain that they offer financial services that shouldn’t be considered wagers. But are they really so different? “Pragmatically, I think for the retail individual, they don’t see a difference,” says Kim. “I think retail individuals trading on these platforms are not thinking of it as not gambling. They’re just thinking of it as one more outlet for them to participate in the opportunity to put money on an event.” Recent research supports this, with a study from the American Gaming Association finding that most Americans view sports-related prediction markets as a form of gambling.10 But at the same time, Kim sees some legitimate arguments from these platforms that they are offering swaps and not wagers, at least when it comes to a strict reading of the law. NEW: The D.C. Circuit vacates Judge Boasberg's order finding probable cause for contempt by the Trump administration in J.G.G., a case over the Alien Enemies Act deportations.

The government appealed the probable-cause order and moved for an emergency stay or a writ of mandamus terminating the criminal-contempt proceedings. The plaintiffs moved to dismiss the appeal. This Court granted an administrative stay pending consideration of these motions. We grant the appellees’ motion to dismiss the appeal for lack of appellate jurisdiction. See Cohen v. Beneficial Indus. Loan Corp., 337 U.S. 541 (1949); I.A.M. Nat’l Pension Fund Benefit Plan A v. Cooper Indus., Inc., 789 F.2d 21, 24 (D.C.Cir. 1986). The panel is unanimous on this point. Judge Katsas and Judge Rao conclude that the government has satisfied the stringent requirements for a writ of mandamus. The Court therefore grants the government’s petition for mandamus and vacates the district court’s probable-cause order. Judge Pillard dissents from the grant of mandamus and the vacatur.

Montana’s Parental Consent for Abortion Act generally requires physicians to obtain consent from parents before performing an abortion on a minor. See Mont. Code Ann. §§50–20–501 to 50–20–511 (2023). Planned Parenthood of Montana filed a lawsuit in Montana state court, seeking to enjoin enforcement of the law. It asserted that the law was inconsistent with Montana’s State constitution. In the proceedings below, the State of Montana argued that the law satisfied state constitutional standards because, among other things, it promoted the right of parents to make decisions concerning the care, custody, and control of their children. See Appellants’ Opening Brief in No. DA 23–0272, pp. 36–37. The State cited a decision of this Court on the rights of parents as support for its argument based on state law, but it did not expressly argue that a holding against it on the state constitutional question would infringe the federal constitutional rights of parents. This has always puzzled me. Technically, the Pope is a foreign sovereign, and a foreign sovereign shouldn't be able to swear or maintain allegiance to another country. But I don't think popes give up their citizenship - do they? Pope Francis didn't give up his Argentine passport.
