It’s definitely useful in Taiwan, politically relevant and encoded in statutes as well

But the benshengren/waishengren distinction matters a lot too and maps along ethnolinguistic lines (esp Mandarin vs Hokkien speakers)

I guess my general position is that the Constitution sets theoretical standards but is mostly too vague to provide practical guidance alone. Congress/courts need to bridge that gap.

Another concern is that 14AS3 is “against the grain” in that applying it requires someone to make an ad hoc determination that a candidate otherwise eligible to the presidency should be barred. So even if it’s self executing in theory (I think it is) it is not so in practice.

I think there’s a pretty big perception issue here in that EP jurisprudence is very well developed (esp since ~1950) but 14AS3 is not, so all actors have more leeway to advocate their desired interpretation (or not, ie Congress)
