The case challenging a $5 million WV Water Development Authority grant to an out-of-state religious school is coming to an end, with a Court declaring the original grant unconstitutional and the Authority agreeing that public funds will not be spent on religious education or advocacy.

The ACLU of West Virginia is aware of efforts made by a local college to intimidate protestors participating in an anti-ICE demonstration today off campus.

Volunteers will be on the ground in Bethany today and will be watching closely.

The Trump administration is removing exhibits that reference slavery from Harpers Ferry National Historic Park, according to news reports.

This government-mandated historical amnesia is the work of racist propagandists, not public servants.

NEW: A court denied a motion to dismiss our lawsuit challenging the state’s unlawful granting of vaccine exemptions.

We won’t stop saying it: The political whims of a governor don’t outweigh the law.
September 15, 2025 at 7:18 PM
We applaud the Ohio County Board of Education for rejecting a proposal that would have allowed students to leave during school hours to undergo “biblical education” by an anti-LGBTQ, anti-abortion religious organization.

The constitution is clear: Our public schools are not Sunday schools.

BREAKING: We won’t stand by while the governor sends vital National Guard resources out of state to participate in a political stunt by President Trump.

We just filed a lawsuit on behalf of WV Citizen Action Group to halt deployment of the Guard to Washington, D.C.
August 21, 2025 at 8:38 PM
Along with Mountain State Justice, we have filed a new lawsuit to halt enforcement of the governor’s executive order on vaccine exemptions.

Our previous lawsuit was dismissed on technical grounds, but we will keep making the case that governors do not legislate by decree.
August 18, 2025 at 6:54 PM
BREAKING: We’ve reached a final agreement on behalf of our client, a Marshall University student whose legal status was unlawfully revoked by the Trump administration.

Under the agreement, the administration is reversing the actions it took against our client, S.V., and will not repeat them.

"My hope in writing 'American Teenager' was to illustrate what should already be self-evident: Trans kids are just kids, no different than any other kid ... deserving of the same respect afforded to everyone else on this planet."

A Court has dismissed our lawsuit challenging Gov. Morrisey's vaccine executive order on a technicality that does not address the merits of our case.

Governors cannot be allowed to legislate by decree. We will continue to pursue this issue.

VICTORY: A court has ruled the WV Water Development Authority unconstitutionally granted funds to an out-of-state religious school.

We’ve said all along it's inappropriate for public infrastructure money to fund religious education and advocacy. This is a big win for church-state separation.
July 9, 2025 at 5:39 PM
BREAKING: The Supreme Court announced it will hear our case challenging the state law banning trans students from participating in school sports.

Lower courts were right to block this discriminatory law and others like it, and we will continue to defend the freedom of all kids to play.
July 3, 2025 at 2:37 PM
Breaking: Our case challenging a $5 million grant in water development funds to a “radically Catholic” school in Ohio can move forward.

Thousands in West Virginia lack clean water. Forcing them to fund this school’s religious mission with money meant for infrastructure is wholly inappropriate.

This is the correct move by the Board of Education. The Constitution doesn't allow the governor to ignore laws he doesn't like.
Defying Morrisey executive order, WV board of ed directs schools to follow existing vaccines law • West Virginia Watch
School officials will instruct public schools to follow the state’s existing vaccine laws, going against Gov. Morrisey's executive order.

Join us as we head to D.C. to meet with Sens Capito and Justice to tell them how important Medicaid is to our state.

Congress is moving on the "One Big Beautiful Bill" act, an ugly bill that would cut hundreds of billions of dollars from Medicaid and deny coverage to some 65,000 West Virginians.

Medicaid is a lifeline for people with disabilities. It's up to us to save it.
As if gutting Medicaid wasn’t enough… • West Virginia Watch
Republicans in Congress aren’t satisfied with just slashing Medicaid, so they are now looking at repealing large swaths of the Affordable Care Act.

We just filed suit along with Mountain State Justice to stop enforcement of Governor Morrisey’s vaccine exemption order.

Governors do not rule by decree. We're suing to uphold the will of lawmakers.

BREAKING: A court will continue to block the Trump administration from re-terminating legal records allowing our client, Marshall grad student S.V., to live and work in the U.S.

S.V.’s records were restored last week after being unlawfully terminated.

By a margin of 78 votes, Morgantown has upheld an ordinance criminalizing sleeping in public for people who have nowhere else to go.

We are disappointed, but this vote does not change people's basic constitutional rights. We will watch enforcement of this ordinance closely.

Our work continues.
April 30, 2025 at 1:15 PM
Tomorrow is the Morgantown municipal election. We urge a “yes” vote on repealing the city’s so-called camping ban.

No one should be locked up for being homeless.

VICTORY: International students across the U.S. are having their legal statuses restored, including our clients at Marshall and WVU.

The administration is backing down because they’ve been dragged to court across the country and lost again and again.
