At the moment, I’m hoping against all hope that the courts will hold on the biggest questions at least. And nobody knows what near-future wildcards and catastrophes might alter the downward spiral. But, at the risk of being called a doomer, it’s clear to me the prognosis is bad.

I know it’s hard to stomach, but we’ve left the territory where a leader believes he needs any valid pretense for his regime’s actions. The truth is something he determines, not something he experiences. It’s a tale as old as power itself, and it’s a hallmark of authoritarianism. It doesn’t really matter if there’s a spectacle of disorder. He’ll simply lie about it or be very confidently wrong — he’s already doing it.

To believe the populace can avoid conflict by not ‘taking the bait,’ or that we can submit our way out of Trump’s attacks, is foolhardy. There’s an air of privilege that, for many Oregonians, is truly unimaginable. As though if they only stay quiet enough, they’ll be alright.

Trump (Miller) is dog-walking the courts to full authoritarian control. While district court judges - the ones on the ground floor who must deal with *facts* - are doing amazing work, it's going to take SCOTUS to rein in this runaway executive. And nobody I know thinks they're up to the task. 6/x

Memphis federalization is legal because the TN governor requested it. Now Oregon's federalization is claimed to be legal because the feds can't keep their driveway clear. In Illinois, the claim is that federalized troops from *other* states can deploy there. 5/x

But we're actually on the proverbial slippery slope: With each Guard deployment gambit, Trump (Miller) pushes the legal envelope: DC deployment was legal because, well, DC is isn't a state. LA federalization was legal because it's "only" protecting federal facilities and federal law enforcement. 4/x

Then there's the letter from the editor @k-rambo.bsky.social, which presents a clear-eyed discussion on the limitations of "not taking the bait." That is, remaining 100% peaceful in our protests so as to remain 100% within the bounds of 1st Amendment speech. And Portland is doing well... So far 3/x

While we wait for the 9th (and now 7th) Circuit to address the issue of guard deployment, I keep coming back to this. If Portland's "facts on the ground" are legally sufficient to deploy military on our streets, the days of whimsy as protest are over. Because why bother. 🧵 1/x

The coming national horror is that if Portland's *truly* minimal level of protest justifies federalizing and deploying troops, they can and will be federalized and deployed anywhere the President wants and whenever he wants.

My initial read on this argument: Judge Nelson is eager to disagree with his 9th Cir. colleagues that federalizing the NG is reviewable at all.

He's also eager to disagree with Judge Immergut that the Portland protests were small and under control.

To further litigate an off-topic pet peeve though - Oregon's public meetings law prevents the sponsor(s) of legislation from soliciting and gathering co-sponsors in advance beyond a quorum. This is a perfect example of an item that should be co-sponsored by the entire council at this agenda stage.

Two big agenda items on next Wednesday evening's City Council agenda: a resolution denouncing attempts to deploy the military, and an ordinance to specifically codify sanctuary city protections.
