As Justice Kagan begins her dissent by pointing out, what is even the point of trial, of fact-finding, of clear error, of standards of review, when the Supreme Court simply ignores every single part of that and decides everything purely on the papers without any real consideration of the facts?
USTICE KAGAN, with whom J USTICE SOTOMAYOR and J USTICE J ACKSON join, dissenting from the grant of the ap- plication for stay. Over the course of three months, a three-judge District Court in Texas undertook to resolve the factual dispute at issue in this application: In enacting an electoral map slanted toward Republicans, did Texas predominantly use race to draw its new district lines? Or said otherwise, did Texas accomplish its partisan objectives by means of a ra- cial gerrymander? The District Court conducted a nine-day hearing, involving the testimony of nearly two dozen wit- nesses and the introduction of thousands of exhibits. It sifted through the resulting factual record, spanning some 3,000 pages. It assessed the credibility of each of the wit- nesses it had seen and heard in the courtroom. And after considering all the evidence, it held that the answer was clear. Texas largely divided its citizens along racial lines to create its new pro-Republican House map, in violation of the Constitution’s Fourteenth and Fifteenth Amendments. The court issued a 160-page opinion recounting in detail its factual findings. Yet this Court reverses that judgment based on its pe- rusal, over a holiday weekend, of a cold paper record. We are a higher court than the District Court, but we are not a better one when it comes to making such a fact-based deci- sion. That is why we are supposed to use a clear-error standard of review—why we are supposed to uphold the District Court’s decision that race-based line-drawing oc- curred (even if we would have ruled differently) so long as it is plausible. Without so much as a word about that stand- ard, this Court today announces that Texas may run next year’s elections with a map the District Court found to have violated all our oft-repeated strictures about the use of race in districting. Today’s order disrespects the work of a Dis- trict Court that did everything one could ask to carry out its charge—that put aside every consideration except get- ting the issue before it right. And today’s order disserves the millions of Texans whom the District Court found were assigned to their new districts based on their race. Because this Court’s precedents and our Constitution demand bet- ter, I respectfully dissent.

The NY Post says they spoke to Cole’s grandmother and his neighbor. Less than a month ago right wing media claimed the #J6 pipe bomber was a woman, a former Capitol Police Officer. Now Bongino is taking credit for arresting this guy whose grandmother says is autistic and not a terrorist. ¯\_(ツ)_/¯
Per NY Post phone interview, Cole's "grandmother Loretta denied his involvement, describing him as "autistic-like" with no political leanings. "He's almost autistic-like because he doesn't understand a lot of stuff. I hope he is not talking. He's very naive...He would not hurt a fly. He's just not that kind of person. I don't believe this at all, he't not a terrorist." Loretta said her grandson rarely leaves the house, only going out for groceries and work. "He's just a gentle person." She said he works at their family bail bonds company, Brian Cole Bail Bonds, which was raided by the FBI. Asked if her grandson was in DC on Jan. 5, Loretta said: "Well, I don't know. He was doing DoorDash for a while." "He doesn't have any ties to DC," she added. "I don't even know how they included him in this." Neighbors outside his suburban Woodbridge, Va. home said he shunned social interactions and often walked a chihuahua to a local 7-Eleven. "He's very antisocial. Very," a neighbor told The Post. "He would never make eye contact. Almost like he just didn't see you,' "noted another resident. He was skeptical about Cole being the suspect, claiming the man seen planting bombs on surveillance footage is taller than Cole. "The guy that I know that walks the dog is pretty short and has real short legs, like uncommonly short legs," the neighbor said. "I would think that a gait analysis would be pretty easy to either rule him out or confirm because his legs are, I would say, uncommonly short." The resident noted Cole stood out for wearing red Crocs and shorts "all winter long."

They could flip 7 GOP seats to make up for this & new GOP maps in Missouri, North Carolina, Ohio, & possibly soon Indiana.

Imposing costs is the only way to deter the GOP from doing this

This light-year-long knot of interstellar gas and dust resembles a caterpillar on its way to a feast. But the meat of the story is not only what this cosmic caterpillar eats for lunch, but also what's eating it. Harsh winds from extremely bright stars are blasting ultraviolet radiation at this "wanna-be" star and sculpting the gas and dust into its long shape. The culprits are 65 of the hottest, brightest known stars, classified as O-type stars, located 15 light-years away from the knot, towards the right edge of the image. These stars, along with 500 less bright, but still highly luminous B-type stars make up what is called the Cygnus OB2 association. Collectively, the association is thought to have a mass more than 30,000 times that of our sun. The caterpillar-shaped knot, called IRAS 20324+4057, is a protostar in a very early evolutionary stage. It is still in the process of collecting material from an envelope of gas surrounding it. However, that envelope is being eroded by the radiation from Cygnus OB2. Protostars in this region should eventually become young stars with final masses about one to ten times that of our sun, but if the eroding radiation from the nearby bright stars destroys the gas envelope before the protostars finish collecting mass, their final masses may be reduced. Spectroscopic observations of the central star within IRAS 20324+4057 show that it is still collecting material quite heavily from its outer envelope, hoping to bulk up in ma...
