Bonus evtl. - bei evtl. doch Scheitern (glaubs ja nicht, aber mal angenommen) könnte die Wahrnehmung etwas weniger sein, dass das BVerfG "gesagt hat, die AfD 'darf weiterbestehen' / ist legitim" (schon sehr spekulativ meinerseits, zugegeben).

Zum zweiten: Ist offensichtlich - sie bleibt wählbar 🫤.

*Aber* - de facto ist es nun mal so, dass das Bundesverfassungsgericht sehr wohl die Gesellschaft und (auch) die politischen Folgen ihrer Entscheidung mit in den Blick nimmt.
Mein Argument daher: die Wahrscheinlichkeit dass das BVerfG die AfD aus der Parteienfinanzierung ausschliesst ist höher!

* Ein (erfolgreiches) Verbot einer Partei die so viele Wähler wählen würde einen (noch größeren) Vertrauensverlust in die Demokratie bei (diesen) Wählern bringen.

Zum ersten - wie du darstellst, rein sachlich/juristisch seh ich auch null Unterschied in der Prüfung ob Verbot oder Ende Finanzierung.

Die "Vorteile" bzw. Argumente die vorgetragen werden, kein Verbot anzustreben, fallen glaub in zwei Hauptkategorien:

* Verbotsverfahren hat das Risiko zu scheitern, und die AfD damit als Legitim hinzustellen.

The Supreme Court’s order, issued for the full court, did not rule on the Justice Department’s October 17 requests for an “immediate” administrative stay or for a stay pending appeal of U.S. District Judge April Perry’s temporary restraining order blocking deployment of National Guard troops in Illinois.

Instead, the court called for additional briefing about the meaning of two words — “regular forces” — in the law Trump is relying upon to federalize and deploy the National Guard.

While that legal issue gets complicated, the big news here is that the court has essentially said that it is not planning to issue an order responding to DOJ’s “emergency” request for at least a full month after DOJ filed the request.

Although it is not a ruling, it is, by implication, a pretty clear statement that there is not a majority of the court ready and willing to side with Trump on this issue at this time.

First, the court has not granted DOJ the “immediate” administrative stay of the TRO that it sought. Although the court has not, technically, denied the request, it’s not going to happen. Further, it took more than a week since the matter was fully briefed on October 21 to get Wednesday’s order — seeking more briefing. And, when the court did so, it set a relatively relaxed timeline, ordering supplemental briefing by November 10, with time for replies by November 17.

After the district court issued a temporary restraining order affecting some aspects of immigration-law enforcement in the Chicago area, the judge on her own motion entered a further order requiring Gregory Bovino, a Chief Patrol Agent at U.S. Customs and Border Protection, to appear in court at 5:45 p.m. every weekday "to report on the use of force activities for each day." The judge justified this order by stating that she had seen videos that led her to question whether the TRO was being obeyed. The order was not, however, a response to any motion by counsel for the plaintiffs (and the videos to which the judge referred apparently do not deal with behavior involving any of the plaintiffs).
The federal defendants seek a writ of mandamus with respect to this aspect (and only this aspect) of the district court's rulings. We issued a stay of the order requiring Chief Bovino to appear and report daily, and we now GRANT the petition for mandamus.

While this litigation presents very challenging circumstances, the district court's order has two principal failings. First, it puts the court in the position of an inquisitor rather than that of a neutral adjudicator of the parties' adversarial presentations. Second, it sets the court up as a supervisor of Chief Bovino's activities, intruding into personnel management decisions of the Executive Branch. These two problems are related and lead us to conclude that the order infringes on the separation of powers. Review by appeal at the end of the case would not solve the problems created in the interim, which justifies review by a prerogative writ. See In re Commodity Futures Trading Commission, 941 F.3d 869 (7th Cir. 2019). Cf. Cheney v. United States
