In a significant decision in Farley v Paymaster 1836 Ltd (trading as Equiniti) (Equiniti), the England and Wales Court of Appeal has lowered the bar for claimants seeking compensation for breaches of their data protection rights.

The Court decided that in England and Wales court proceedings the concept of "non-material damage" arising out of infringements of data protection law is aligned with the case law of the Court of Justice of the European Union (CJEU) (for example, as explained in 2023 in the Austria Post case). There is no so-called “threshold of seriousness” that a claimant has to overcome to be entitled to compensation.

Bourgeois and Blake
Leave behind those
Who would rather bruise than applaud
They burrow like botflies
And beam when there's blood
No time for bludgeoning Be braver than the bitter
Put away your broad axe
Make the barren bounteous
Leave seeds upon your tracks

BEACH READS
On the beach I find a library
Each stone I turn Each shape I hold
Holds stories - both truth and mischief
I stare at some
Inscrutable
I don't have the reading glasses required
So I turn to my geologist friend
Who wears the spectacles of science
We turn to the monocle of myth
Our pattern-seeking mind finds a face Smuggler, pirate or buccaneer soul
Trapped in stone
Waves crash our minds into the sadness of the Selkie And a Kraken waiting just beyond the skyline
Driftwood sea smoothed into dinosaurs And other marionette megafauna
The mermaids purse pickpocketed by the seaweed
Coffee calls our cold hands
As the stones call for our attention
"The tide will take me
Don't you want to hear my tale" And shivering we stay
Enraptured
And hear the hag stone laugh
