I am in the Admin Court this afternoon for a permission hearing. Case concerns council estate block with a lift that consistently breaks down and Hackney Council's treatment of a disabled tenant with mobility needs who cannot access his second floor flat without a lift.

First-tier Tribunal accepted argument that my disabled benefits client was not notified properly about the duty to disclose. Her overpayment of £17k, reduced significantly due to technical arguments about calculation of income, is not recoverable as a result!

Just been granted permission to bring a judicial review claim which the Legal Aid Agency said had poor merits. LAA refused to overturn their decision on review and appeal and only reversed their decision when a detailed LBA was sent by my sols. Access to justice can be undermined in “hidden” ways.

🥳Eviction stopped! A HASL family were facing a no-fault eviction from their private rented home. With the help of @southwarklawcentre.bsky.social @jogilvieharris.bsky.social the judge threw out the landlord's case and our members have won more time in their home! Hurray for landlord licensing!

We were granted permission today, but stayed pending First-tier Tribunal proceedings.
Pleased to say that my client has been granted permission to bring his judicial review.

USA under Trump is following in the footsteps of the UK under Conservative government. They have their own Rwanda case (El Salvador - although perhaps on a different scale) and now their own “Good Law Project case” on automatically deleting messages (again different scale).

Thread from last evening in the progress of the deportations court order case.

Yes, those watching may be frustrated at the judge not yet imposing sanctions.

But he is going about this in exactly the right way. These things take considerable skill and patience.
You all have the benefit here of watching, in real time, an experienced savvy judge close down slowly and methodically every avenue of escape for the US government.

This is an outstanding forensic exercise.

They are becoming cornered.

Successful application to have a possession order and warrant of eviction set aside today. Private landlord did not validly serve claim form on “all other occupiers”. Anyway, r. 3.1(7) discretion exercised because no notice of hearing and defence that NTQs don’t end assured tenancies.

I understand your point. But what happens where a polycentric decision is made which doesn’t factor in art 8. In those circs, court is to apply judicial restraint: eg see Carlile v SSHD. Shouldn’t the court simply quash the decision and remit it for reconsideration?
Yes. That was part of the reasoning in Ghaoui. On the other hand, it is also clear that Strasbourg requires that the *decision making process* complies with art. 8 ECHR by providing sufficient protection to the right, which is a procedural protection.
