Administration is moving to formally nominate Lindsay Halligan--yes you heard right -- to the EDVA US Attorney position. That's a capitulation to the law and adverse decisions -- it's a totally kosher way to install her. Only problem is will Senate go along? Look for serious arm-twisting by Admin.

I'm pretty sure all of us who've lived in Houston know what's causing the exodus. It is a great city, and it's rapidly becoming unlivable. We were flooded out of our house all the way back in 2001 -- a hundred year flood. One of what -- four in 20 years? What will wet bulb temperatures be by 2030?

#Poet Emily Dickinson was born #OTD in 1830.

She wrote ~1,800 poems & only 10 were published in her lifetime (& heavily edited by publishers to be "normal"). Unrecognized in her time, Dickinson was known later for her innovative use of form & syntax and influence on #poetry styles like free verse.

JUST IN: Assistant U.S. Attorney Jeffrey Snell just confirmed, at the prodding of U.S. Magistrate Judge Keri Holleb Hotaling, that this motion for dismissal followed a "no bill" from a grand jury.

That means the grand jury refused to indict.
U.S. prosecutors in Chicago are dropping another case tied to Operation Midway Blitz, "without prejudice."

It's USA v. Nathan Griffin. Below is the motion, followed by excerpts from the complaint.

The feds don't say why they're dropping it, but they had until today to secure an indictment.

Today it was my honor to present oral argument in the 14th Court of Appeals in Houston, Texas, on behalf of my client.

The issue is whether a trial judge in a criminal case can tell the jury that "beyond a reasonable doubt" can be as low as "60 percent."

This system was also more flexible and durable: write broad laws that delegate, then let an agency monitor and shift the specifics of regulation to meet the times. Having to do everything by statute isn't just time consuming, it's dumb. And Congress has now long been unable to do the bare minimum.
🧵 Also: Much legal theory seems to be based on a fantasy Congress.
The administrative state grew because Congress, which has a limited number of people with extraordinary time demands, delegated to specialists.
It now has the same number of people, demands are worse and tasks are more complex.
