Issue that few are picking up with the ruling is that it's main beef was with the internal contradictions in the language used across different legislation -- it's impossible to make sense of the law as an integrated system. It was a very technical ruling.

I don't think they're evasive about it -- the justification for the new regs is to preserve a distinction (i may be paraphrasing v. slightly) and that's clearly about the aesthetics of it. I don't know that I especially disagree with that either.

Months of consideration, and still a piece of legislation that fails to clarify whether a helmet that only partially covers the ears is permitted.

Also, I don't see what is added by banning both "covering" and "enclosing" the ear.
