They believe that Trump will use the formal powers of the government and whatever informal powers he may have to extract costs from them if they do not play ball and they equally believe that the anti-Trump coalition will not extract these costs.

So we need to extract those costs.
given how unpopular Trump is, it’s insane that civil society/universities/law firms are still asking themselves “how do I stay on Trump’s good side” rather than “how do I avoid facing consequences for complying with Trump’s illegal demands”

Before this ruling, the Trump admin had said that anyone who originally crossed the border without authorization was to be held in immigrant detention without the chance for release on bond. This had left lawyers scrambling to file habeas petitions for their detained clients.

For no particular reason, casually thinking about how the federal judiciary has no obligation to defer to the BIA in the post-Chevron world.
Just saw this today. This is a transparent attempt to KILL DUE PROCESS by lying about the job of immigration judge and stacking the deck through hiring only bloodthirsty lawyers who want to deport people.

This comes after they pushed out over 100 judges deemed too likely to grant relief.
DOJ is now recruiting for immigration judges by calling them “deportation judges.”

That’s seems really bad.

I’m not actually sure if it is within Democratic strategists’ power to ignore this, even if they want to. As the 2026 (and eventually 2028) primaries become crowded, ambitious candidates will be incentivized to say what voters actually want to hear.
made a similar point on the opinions podcast this week in response to the idea that epstein is a dead end. not only are actual voters interested in this but it divides the gop and puts pressure on the president. it would be political malpractice to treat it as a sideshow
