The fight here with Gorsuch and Kav vs Nelson is whether the "use" of race automatically means "discrimination" on the basis of race.

That's interesting to me, because it's basically the white folks telling on themselves. They cannot see a "use" of race that isn't synonymous with discrimination.

Alito is saying that the black population in Louisiana is not geographically "compact" enough for the black population in Louisiana to have fair voting rights.

Kavanaugh looking to find the "end point" when the Court no longer has to worry about the intentional use of race to create black districts.
I'd say "WHEN WHITE FOLKS STOP INTENTIONALLY USING RACE TO DECREASE BLACK VOTING POWER" but he thinks white people doing that is cool.

It's important to note that Roberts and Kavanaugh were the two Republicans who broke from their party in the Alabama case. So their questions matter most here.

Alito asks If a majority of one race overwhelming vote for one party regardless of the race of the candidate, is that racial bloc voting?

Nelson says of course. Alito says, somehow, no. It's just political voting.

Roberts is saying that the court's own precedent from a couple of years ago, where it ruled that Alabama had to draw racial fair maps, doesn't apply to this (identical) case, essentially because the Alabama case was poorly argued.
It's a terrible argument, but the hill Roberts is gonna die on.
