And to clarify, Trump would have to provide notice of the covert action "as soon as possible" or at least "in a timely fashion" to SSCI and HPSCI, but after that there is no ongoing reporting, AFAIK. /END

Technically, covert action cannot involve "traditional military activities" -- presumably to ensure that this is not exploited precisely in this way, as a loophole for unaccountability -- but it's not clear what that means and how it would be enforced 9/

The fact that they apparently don't care that Venezuela (and the world) knows that the CIA is doing this -- in fact, it sounds like they very much want it to be known -- tells me that they don't care about plausible deniability, just a more flexible legal ground to continue what they are doing 8/

It also doesn't have to be justified based on Article II war powers, which do not provide any justification for the current strikes in the Caribbean. In short, the Trump admin can keep doing their drug boat drone strikes through this if the military option starts getting jammed up 7/

Following Iran-Contra Congress put a bunch of guardrails in place for covert actions through the Intelligence Authorization Act of 1991. In particular, to undertake a covert action, POTUS must sign a written finding that the CA is necessary to support "an identifiable foreign policy objective" 4/

These operations are covert in order to conceal the role of the U.S. in them -- basically providing "plausible deniability" so that these kinds of things can, theoretically, happen simultaneously as other overt (e.g., diplomatic) efforts towards the same goal. More on this in a bit. 3/

I suspect that Ellis installed himself in order to ensure that the agency provided requisite intelligence/findings to support the President's sign-off. But why CA, if the military is already doing stuff? Well, CA involves the CIA, not the military, and evades the War Powers Resolution, for one 5/
