Chaos mongering and the topography of joy
Some politicians in BC are stirring up some pretty alarming notions about a false threat to private property stemming from a recent Court decision affirming the Cowichan Tribes' Aboriginal title. As a person involved in the field for decades, it's terrible to watch the lies and racism spread fear to people that are under no threat at all. Horribly irresponsible politicians who know better are smirking through their faux serious stances as they watch the chaos they are sowing spread across the land.

My advice to all of us is to "chill the fuck out." The BC Treaty Process has been in place since 1991 to deal with these issues and create resolutions and certainty for everyone. Declarations of Aboriginal title in places like Haida Gwaii do the same thing. These are negotiated agreements.

They are willing to ignore Canadian law, pursue a policy of legal genocide, which is what unilaterally extinguishing Aboriginal title amounts too, and they don't have your best interests at heart. They want you to be afraid and to look to them for leadership and solutions. Don't be fooled.

Reconciliation is not wearing orange shirts and learning about residential schools. It is about reconciling the existience of Aboriginal title and Crown title in what is now Canada. First Nations have been asking to do this since the very first contact with Europeans. It is not new.

The solution they are proposing, in Richmond Councillor Alexa Loo's words "to extinguish Aboriginal title" shows such a laughingly ignorant take on Canadian law, that the Court will simply throw that idea out. Since 1997, Aboriginal title has been recognized in Canadian law. You can't throw it out.

Aboriginal law and Aboriginal title in Canada is confusing for folks who don't understand the law or haven't followed these issues for decades. That confusion makes it easy to exploit fear. You now have property owners saying they are afraid their private properties will be seized. That's not true.

There’s an aboriginal tribe who always refer to directions by their orientation. So it’s not left foot, it’s north foot (if the foot is to the north). Standing in a room inside with no windows they know which direction they are facing and their kids can’t understand why outsiders can’t.
