I think you misunderstand. There is nothing to fight. It won’t (can’t) be brought and any attempt can be sacked off by any half decent attorney with a single letter saying they are awaiting the statutory guidance before confirming their position.

They don’t need to fund it yet. There is no litigation and there won’t be while legal challenges are in process and EHRC guidance remains in draft.

I think this is a misunderstanding of the situation. In the absence of ratified statutory EHRC guidance, there is near zero chance of successful litigation. No gun is being held to their head. The gun doesn’t yet exist. It’s still complying in advance, at this point.
