He also ordered state agencies to expand their assessment of the risks from potential catastrophic events.

Codifying rules such as this usually means moving responsibility to the policymakers (in practice it is, of course the affected that pay the price). Consider the following argumentation from Bloxham v. Glock Inc.:

The advantage of the common law approach is its flexibility: (excerpt from the report mentioned above)
Existing legal standards about liability for misuse may be somewhat murky and unclear in application, but they are also flexible and dynamic—qualities that a more precise set of legal standards, enacted through legislation, would by their nature lack. Thus, we believe that legislatures would be well advised to proceed with considerable caution in this area. While legislation could improve this difficult and murky area of law, it could also inhibit its ability to flexibly address situations that are difficult to analyze in advance.

Dark Llama 3.5 405B - a hypothetical crime coach and assistant based on Meta AI technology (Meta spent millions to train it) and fine-tuned by somebody else - helps a young lady prepare and conduct her criminal activities. It also encourages her and gives her social advice - how to establish cooperation with other criminals and how to deal with them. She has a pretty face, but is not very smart. She wouldn't have accomplished it on her own. The information that the assistant provides is all publicly available - the value it offers is in personal approach and willingness to help. The assistant is much more generally knowledgeable and in many ways smarter. In such a case, SB-1047 would have absolved Meta AI from any responsibility. Without SB-1047, under common law, the judge and the jury would have to decide. If you were on the jury, what would you do?
