oh yes! Thank you for posting this. My sorrow and rage from the destruction of those lists... It was so inexplicable and so hamstrung those of us doing local organizing.

Performative decency is actually *so* important for this reason.

It tricks the 10% of ghouls into thinking that there are only 1% of ghouls.

And it makes the 30% of people that don't care one way or another follow the mostly decent crowd

KBJ threaded the needle thanks to CA1’s unfinished business.

-if she denied the admin stay, the full SCOTUS woulda stepped in to override her.
-if she immediately referred the case to the full Court, they coulda dragged feet.
-instead she boxed them in to act quickly once she does refer the case.

the jury had questions about definitions, so they gave the question of guilt deep consideration. Both could have happened: "it's not assault, because there wasn't even a chance of bodily harm" + "well it was an offensive touching so technically an assault but come on" = not guilty

I've conducted jury trials and I too have seen that they take things very seriously. It's a higher bar to convict someone with a jury than a judge, because they are not jaded, and they take "beyond a reasonable doubt" to heart.
