Second, the dept says in its announcement that Cal has a "history of violating" the Clery Act b/c of case from a few years ago. Never seen the Ed Dept say something like that in announcing an investigation that a school did something wrong several years ago

For one, the department often fights against revealing when it's doing Clery Act investigations. I submitted a bunch of FOIAs over the years to find out who's under investigation and it always refused
