We could ALWAYS use Chapter 75 and couch unacceptable performance as misconduct (e.g. failure to follow instructions) but typically didn’t because there are a lot of hurdles, including the need for progressive discipline.

This is a policy decision made by people who don’t know why practitioners actually prefer Chapter 43 removals for performance. Namely, lower burden of proof and no mitigation by the board.

This will likely increase the pace with which employees are removed but doesn’t actually lower the bar for removing underperforming employees. And the example Douglas Factor analysis looks like the type that would get the MSPB to mitigate the penalty.

They control all of the levers of government so it doesn’t matter what anyone else does. Congress is totally cowed, the SC is in the tank, and they have a private goon squad with zero compunction about violating civil rights. People marching doesn’t concern them.

Like a boulder rolling down a hill, it’s far easier to stop it at the top than just before it crashes into the town at the bottom and congressional republicans are gambling democracy on either being able to stop it at the last possible moment or that it will veer away from the town at some point.

I get that they *probably* think that they would object if he truly went too far (whatever that would mean for each), but they simply do not appreciate how difficult it’s going to be to stymie authoritarianism now that it is gaining momentum.
